To address the prevailing issue of tenant harassment in New York, in addition to ensuring the safety of tenants during building construction, today the City Council will pass a pair of bills sponsored by Council Member Mark Levine that will protect tenants from abusive landlords.
Council Member Levine’s bills are part of a two legislative packages that will provide greater protection for tenants, especially in regards to the use of construction as harassment by landlords.
“New Yorkers have the right to live without fear of being preyed upon in their own home,” said Council Member Mark Levine. “No New Yorker should live in fear of being preyed upon in their own home. The legislation we are passing today, including two of my own bills on tenant harassment and safety, will take the critical steps necessary to protect vulnerable tenants from abusive landlords.”
Council Member Levine’s bills include:
· Int 1548, which will amend the definition of harassment to include repeatedly contacting or visiting a tenant before 9 a.m. or after 5 p.m., without previous permission from the tenant.
· Int 936, which will require landlords to create and distribute more robust tenant protection plans when doing construction, including:
o Landlords must provide information about work being done to remove mold, in addition to asbestos and lead paint
o Landlords must provide information about work being done that will affect essential services such as heat and hot/cold water, gas, electricity, and other utilities.
o Requiring the DOB to post tenant protection plans to their website, and landlords to prominently place tenant protection plans in the building’s lobby as well as on each floor.
o Gives DOB the power to issue a stop work order for failure to comply with the City’s tenant protection plan laws.
